Terms and Conditions
These Terms apply where Hasfarm Australia Pty Ltd (ABN 32 001 695 665) trading as Hasfarm Market Direct (Hasfarm Market Direct) supplies Goods to a Customer.

All purchases are to be paid in full upon collection or prior to delivery.
Some product lines require a minimum of 2 to 3 weeks' notice to secure stock. Please consult our sales team regarding specific lead times for our various product ranges.
While we always strive to fulfill your order precisely, flowers and foliage are natural products subject to weather, growing conditions, and seasonal availability. Consequently, we cannot guarantee exact color shades, precise dimensions, or continuous stock availability of specific botanical varieties.
Subject to any Non-Excludable Rights that apply under the Australian Consumer Law (ACL), Hasfarm Market Direct will not be liable for any failure or delay in fulfilling an order if the failure arises from:
Products being out of stock or out of season;
Production issues, agricultural flaws, or natural faults;
Natural seasonal variations, weather events, or growing conditions; or
Unforeseen circumstances beyond our reasonable control (force majeure).

The Australian Consumer Law provides Consumers with a number of Consumer Guarantees that cannot be excluded or limited. The limitations of liability set out in these Terms are therefore subject to, and will not apply to the extent that they limit or exclude such Consumer Guarantees.
Except only for those rights and remedies that the Customer has in respect of the Goods under the Australian Consumer Law which cannot be lawfully excluded, restricted or modified:
(a) Hasfarm Market Direct excludes any liability for Consequential Loss;
(b)All conditions, warranties and implied terms, whether statutory or otherwise, are excluded in relation to the Goods; and
(c)Hasfarm Market Direct is not liable to the Customer for any Loss which the Customer suffers, incurs or is liable for in connection with supply of the Goods under the Contract except in accordance with this clause 15.

The terms and conditions set out in this clause 13 apply where Hasfarm Market Direct issues a Customer with store credit, which the Customer may use to purchase or make payment to Hasfarm Market Direct for Goods (Store Credit).
Using Store Credit
(a)Store Credit may only be used at the store in which it was issued. At this time Store Credit cannot be used to purchase Goods on the Website.
(b) If a Customer's Store Credit exceeds the total amount of the Customer's Order, the remaining balance of the Store Credit will be automatically updated.
(c) If a Customer's Order exceeds the value of the Store Credit, the Customer must pay the remaining balance of the Order by an alternative form of payment.
(d) A Customer cannot exchange Store Credit or any part of it for cash.
Cancellation and expiry of Store Credit
(a) Store Credit is valid for thirty six (36) months after the date it is issued.
(b) Any balance remaining on the Store Credit after its expiry will be forfeited and will automatically become the property of Hasfarm Market Direct.

Subject to any Non-Exclusable Rights that may apply to the Customer, all returns for Defective Goods will be dealt with at the store level, and no refund or exchange will be provided to the Customer for any change of mind or an error in ordering the Goods.
General Returns & Change of Mind
(a) Subject to any Non-Excludable Rights, all returns for Defective Goods will be dealt with at a store level in accordance with the process outlined below.
(b) Due to the perishable nature of fresh produce and flowers, no refund, exchange, or change of mind returns will be provided to the Customer for a change of mind or an error in ordering the Goods.
Defective or Damaged Goods (Fresh Produce Policy)
(a) The Customer must check whether the Goods are defective or damaged as soon as possible after collection or delivery.
(b) Given the short shelf life and perishable nature of fresh produce, claims regarding defective or damaged goods must be flagged, accompanied by full details and photographic evidence, within three (3) days of receiving the Goods. If the Customer does not notify Hasfarm Market Direct within this window, the Customer is deemed to have accepted the Goods, subject to any Non-Excludable Rights.
(c) Upon receiving a defect notice, Hasfarm Market Direct will review the details to determine, acting reasonably, whether the Goods are defective. Hasfarm Market Direct may request further information, photos, or an inspection if required.
Remedies for Defective Goods
If Hasfarm Market Direct determines, acting reasonably, that the Goods are defective, it will, in its sole discretion and in accordance with the Australian Consumer Law, provide the Customer with an appropriate remedy, such as: (a) a repair of the Goods (where applicable); (b) a refund of the cost of the Goods; or (c) a replacement of the Goods with goods that are at least equivalent in function and quality.
